Common terminology in contracts
Regarding Fences

FENCE AND GATE TYPES WE OFFER
We are a company set up to supply, install, repair or replace a variety of commercial and industrial fences and associated gates, which may include, but are not limited to, the following: Galvanized and Vinyl Chain-link; Treated Wood Board; Wrought iron; Fixed Knot Field Fence; Barbed Wire/Razor Ribbon Vehicle Barrier Gates; Motorized access gates; and Gates with remote access entry.

FENCE AND GATE REPLACEMENT AND REPAIR
The most common are:
1.83m (72inches) G.A.W. (Galvanized After Weaving) Chain Link Fencing
The following are the specifications Vendors shall use to build and price 1.83m (72 inches) Tall G.A.W. (Galvanized After Weaving) Chain Link Fencing:
Terminal Posts Terminal posts comprising of end, gate, corner and straining posts shall be standard seamless, continuous weld, schedule 40 hot dip galvanized steel pipe weighing 11.28kg per linear metre.
Posts shall be supplied with weatherproof caps. Tubing, conduit or open seam material will not be accepted.
Terminal posts shall be 1.83m (72 inches) above ground height, 26.67cm (10.5 inches) length with a diameter of 8.9cm (3.5 inches).
All terminal posts to be set in a concrete footing with a diameter of 30.5cm (12 inches) and at a minimum depth of 1.2192m (48 inches) to ensure the installation will not be compromised by the frost line.
Line Posts Line posts shall be standard seamless, continuous weld, schedule 40 hot dip galvanized steel pipe weighing 5.43kg per liner metre.
Line posts shall be supplied with weatherproof eye top caps to accommodate a continuous horizontal top rail.
Line posts shall be a 3.2m length and a diameter of 6cm (2.37 inches).
All line posts to be set in a concrete footing with a diameter of 25.4cm (10 inches) and at a minimum depth of 1.2192m (48 inches) to ensure t
Top Rail Top rails shall be standard, continuous weld, schedule 40 hot dip galvanized steel pipe weighing 3.38kg per liner meter. Top rails shall be 6.7m (264 inches) in length and have an outside diameter of not less then 4.3cm (1.69 inches). Top Rail Sleeve Couplings Top rail sleeve couplings shall be schedule 40, hot dipped galvanized steel pipe, 16.18cm (6.37 inches) long and a 45mm (1.77inches) inside diameter to accommodate a 43mm (1.69inches) outside diameter top rail and manufactured specifically as a bottom and top rail sleeve coupling for chain link fencing.
Fabric Fabric shall be No.9-gauge steel wire woven into a uniform twoinch diamond pattern mesh or as otherwise specified by the Agency. Size of the mesh shall be determined by measuring the minimum clear distance between the wires forming the parallel sides of the mesh. Permissible variation in size of mesh shall be three mm. The diameter of the wire shall be no less than 3.68mm. The top and bottom selvage shall be knuckled. Fabric shall be Galvanized (Zinc) coated after weave Fabric shall not be excessively rough, blistered, bruised or flaking. Chain link fabric shall have a minimum tensile strength of 415 MPa.
Bottom Tension Wire Bottom tension wire shall be No. 6 gauge single strand galvanized steel wire.
Turnbuckles Where turnbuckles are required, they shall be drop forged steel and be hot dip galvanized. The average overall length shall be approximately 30.48cm (12 inches), with ends in the closed position. Bolt diameter shall be 10mm and shall be capable of taking up to a minimum of 15cm (5.9 inches) slack.
Braces Bands Braces shall be schedule 40 hot dip galvanized steel pipe, not less than 43mm (1.69 inches) outside diameter and weigh 3.38kg per linear metre.
Fittings and Accessories The following Fittings and Accessories shall be used with the 1.83m (72 inches) Tall G.A.W. (Galvanized After Weaving)
Chain Link Fencing: Tension bars shall be 5 x 19mm galvanized flat steel and not less than 50mm shorter than the height of the fabric with which they are to be used.
Tension bands shall be 3 x 19mm galvanized flat steel complete with 8 x 32mm galvanized carriage bolts and nuts. Brace bands shall be 3 x 19mm galvanized flat steel complete with 8 x 32mm galvanized carriage bolts and nuts to fasten top rail receptacles to terminal posts.
Cut ends of tension bars shall be ground smooth to remove all sharp edges and burrs.
Fabric clips shall be No. 9 gauge aluminum alloy wire. Weatherproof post tops, caps, receptacles and fittings shall be of adequate strength and may be of aluminum alloy, malleable steel or pressed steel. All ferrous metals shall be hot dip galvanized.
Concrete Where concrete piles are specified for post installation, the concrete shall be cast in place and be sulphate resistant type 50, minimum compression strength of 25 MPa at 28 days.
The concrete shall have a maximum slump of 80mm and a maximum size of course aggregate of 40mm. 1.22m (48 Inches) G.A.W. (Galvanized After Weaving) Fixed Knot
Field Fence The following are the specifications the Vendor shall use to build and price 1.22m (48 inches) tall G.A.W. (Galvanized After Weaving) Fixed Knot Field Fence:
Steel Fence Post (T-Posts) Steel fence posts to be installed at intervals of 3.66 meters and set at an appropriate height in relation to the fence after being set in earth at a minimum depth of 1.2192m (48 inches) to ensure the installation will not be compromised by the frost line.
Steel fence posts to be placed on either side of the wooden posts and at a ratio of two steel posts for every one wooden post. Steel posts shall only be used as line posts and installed with a post driver.
Wooden Fence Post Wooden fence posts are to be 10.16cm by 10.16cm (four by four inches), arsenic free pressure treated and used as anchor posts. Concrete shall be used in the installation of anchor posts. Anchor posts shall be used at the corners or ends of the fence and every 9.14 meters throughout the length of the fence.
Anchor posts to be set at a minimum depth of 1.2192m (48 inches) to ensure the installation will not be compromised by the frost line, and include proper diagonal bracing techniques.
Fabric Fabric shall be Class three, 12.5 gauge, 15.24cm (six inch) spacing, G.A.W. fixed knot field fence.
The fabric is to be installed at the correct tensioning according to the manufacturer’s specifications.
Fittings and Accessories All fittings and accessories shall be adequate strength and may be aluminum alloy, malleable steel or pressed steel. All ferrous metals shall be hot dip galvanized.
Concrete Where concrete piles are specified for post installation, the concrete shall be cast in place and be sulphate resistant type 50, minimum compression strength of 25 MPa at 28 days.
1.83m (72 Inches) Tall Treated Wood Board Privacy Fence (Shadowbox) The following are the specifications Vendors shall use to build and price 1.86m (72 inches) Tall
Treated Wood Board Privacy Fence (Shadowbox): Wood Panel Board:
The wood panel boards are to be 2.54cm (one inch) in thickness by 15.24cm (6 inches) in width by 1.83m (72 inches) tall and be composed of arsenic free pressure treated pine.
The fence shall be constructed as a double-sided privacy fence. Knots in slats shall be no larger than 6.35mm (1/4 inch).
The fence shall be constructed as a double-sided privacy fence.
Wood Fence Posts:
Fence posts shall be minimum 10.16 cm (four inches) by 10.16cm (four inches) and spaced a maximum of 2.44m (96 inches) on centre.
The posts are to be embedded 61cm (24 inches) into a 25.4cm (10 inch) diameter concrete footing and at a minimum depth of 1.2192m (48 inches) to ensure the installation will not be compromised by the frost line.
The concrete shall extend from the fence post to the finish grade and have a sufficient pitch to shed water away from the post. Post lumber must be Number two grade or better and be decay and insect resistant.
Rails:
Top, bottom and middle rails are to be installed using corrosion resistant rail hangers and/or deck screws and installed from centre of post to centre of post.
Rails are to be 5cm (two inches) by 10.16cm (four inches) and must be of Number two grade or better.
Rails are to be decay and insect resistant.
Fasteners:
Wooden fence boards should be attached with at least two, 3.81cm (1.5 inch) length screws at each post, per board. Rails shall be attached to posts with at least two minimum 7.94mm (5/16 inch) diameter by 8.9cm (3.5 inch) diameter length bolts at each connection point.
All fasteners shall be corrosion resistant.
Concrete:
Where concrete piles are specified for post installation, the concrete shall be cast in place and be sulphate resistant type 50, minimum compression strength of 25 MPa at 28 days.
As Required Fencing Types
Other types of fences that may be required during the course of this Contract are as follows:
Wrought Iron:
The successful Vendor will recommend wrought iron fence designs to the Agency’s Property Manager or designate for approval.
All repairs and replacements must match the existing fence designs at each site, unless otherwise specified by the Agency’s Property Manager or designate.
Post and Split Rail:
Post and Split Rail Specifications are as follows:
All rail lengths will be at a minimum 2.44m (8 ft.) to a maximum of 3.05m (10 ft.);
All screws nails or metal hardware being used must be stainless steele or hot dipped galvanized;
and Rail posts shall be installed to ensure that water will drain away from the bottom of the post therefore increasing the longevity of the installed post.
Barbed Wire:
Barbed wire shall be installed when this is identified as a necessity by the Agency’s Property Manager, for security.
Barbed wire arms to support the wire shall be installed with the arm pointing away from the roadway.
Barbed wire specifications are as follows:
Number of Strands: Two;
Minimum Wire Gauge: 12.5 American Wire Gauge (A.W.G.);
Maximum Spacing between Barbs: 152.4mm (6 in.);
Number of Points per Barb: Four; and Galvanized: Canadian Standards Association (CSA) G164

INSTALLATIONS
All installations must meet the American Society for Testing and Materials (ASTM) Standards. The successful Vendor shall review with the Agency’s Property Manager or designate all preparatory work, such as fence or gate installation, fence or gate type, sub-grade or sub-base, materials, site compaction, soil conditions, locates and site layouts including grade stakes indicating finished elevations prior to commencement of any work. All installations must be approved by the Property Manager, or designate, in advance with a formal quote submitted by email.
All quotes must be broken down into the following applicable categories:
Labour, Parts/Materials, Permits, Equipment/Vehicles, and include a subtotal before taxes. Charges for labour must include a breakdown clearly stating the number of technicians required, the hourly rate per technician, and the estimated amount of hours required. The Agency reserves the right to obtain competitive bids and award to other Vendors.

LOCATES AND STAKE OUTS
All existing services are to remain intact unless otherwise indicated by the Agency’s Property Manager.

POSTS
When a new installation is deemed necessary by the Agency’s Property Manager or designate, the Agency shall arrange a site visit with the successful Vendor to stake out the perimeter of the fence outline. The successful Vendor will then create a string line to use as a reference for the setting of posts.
Marking paint shall be used to mark the spots where the posts shall be placed.
All posts shall be accurately plumbed, uniform and set in line and position.
All posts shall be installed at a minimum depth of 1.2192m (4 ft.) to ensure the installation will not be compromised by the frost line.
Posts shall be compatible with the specified fence height and cut to the required height above ground to present a smooth and uniform profile.
Line post spacing shall be in equal horizontal distances with a maximum of 3m (9.84 ft.) between line posts.
Corner posts shall be installed at horizontal deflections in the fence line of 10 degrees or more.
Straining posts shall be installed at equal intervals not exceeding 150m (493 ft.).
Additional straining posts shall be installed where changes in vertical alignment of the fence exceed 30 degrees.
The successful Vendor shall remove debris and correct ground undulations along fence lines to obtain smooth uniform gradients between posts.
Provide clearance between bottom of fence and ground surface, not less than 30mm (0.0984 ft.), and not more than 500mm (0.164 ft.).

POSTS ON CONCRETE BARRIERS
All posts installed on a concrete barrier shall be fastened to the concrete using proper materials for the work being completed.

CONCRETE FOOTINGS
All posts set in earth, loose or friable rock, or where overburden solid rock is 0.45m (1.47 ft.) or greater shall be set in concrete footings that are rough cast in the ground and domed above grade to shed water and to the dimensions as specified on the advice of the Vendor and as approved by the Agency’s Property Manager. The successful Vendor will ensure proper backfill and grading around all footings to ensure integrity.

BRACING
A brace shall be placed diagonally across the panel at all ends and gateposts. Corner and restraining posts shall be supported with diagonal braces placed on both sides for stability. The higher end of the diagonal brace will be connected at the terminal post.

GATE INSTALLATION
All gates shall have a chain hook to hold gates open and double gates shall have a steel gate center rest with a drop bolt for the closed position. When requested by the Agency’s Property Manager or designate, some gates will require a gate anchor to ensure the gate stays open or closed. Upon replacement, repair or new installation of a gate, the successful Vendor will ensure the surface grade within the required gate sweep area shall be low enough to permit free movement of the gate, and the gate opens and closes without any obstructions preventing it from doing so.
When a gate is being replaced or repaired the successful Vendor will ensure that the gate will swing open in the original intended direction unless the Agency’s Property Manager or designate advises otherwise.
If barbed wire is deemed necessary by the Agency’s Property Manager it shall be constructed with the wire edge at the top of the gate, and installed in accordance with Scope of Work, Section 6.4.3, Barbed Wire.
Where a gate replacement, repair or new installation has a striker and a receiver the Vendor will ensure that the striker and the receiver meet perfectly to obtain the closed position of the gate.
Fencing hardware and anchors shall be installed to be compatible with fencing type specifications for load bearing purposes, i.e.
weight, stability and to prevent gate ends from swinging and sagging.

VENDOR’S EQUIPMENT
The successful Vendor is required to supply all equipment required to perform the Work including, but not limited to:
Tractor Auger (Post hole digger);
Power Auger;
Loader;
Vactor Truck;
Dump Truck;
Skid Steer;
and Lift Equipment Vendors shall list all equipment they will be using to perform the Work under this Contract in the on-line bidding forms.

MATERIALS
The successful Vendor must provide samples of all materials to be used for approval by the Agency’s Property Manager or designate prior to commencement of work.

ADVERSE WEATHER
All work shall be undertaken in consideration of weather conditions and in accordance with the product manufacturer’s requirements.
The successful Vendor shall ensure materials or products are not installed under adverse weather conditions that may affect the quality or integrity of materials.
The successful Vendor is to carry out all work to ensure the site is kept dewatered in order to prevent construction delays.
In the event of inclement weather stopping or preventing scheduled work, minimum call charges would apply, provided the Vendor has attended the designated work site.
No additional travel or mileage charges will be paid by the Agency.

REPAIRS AND REPLACEMENTS
Fences and gates that are repaired or replaced shall match existing fences and gates already installed on site.
The successful Vendor will ensure stability and ensure all necessary steps have been taken to enforce the integrity of the fence.
In the event of interruptions to the work schedule for repairs and replacements to fences and gates, the successful Vendor shall secure the area with temporary fencing and gating.
All repairs and/or replacements must be approved verbally by the Property Manager, or designate, in advance with a formal quote submitted by email.
All quotes must be broken down into the following applicable categories:
Labour, Parts/Materials, Permits, Equipment/Vehicles, and include a subtotal before taxes. Charges for labour must include a breakdown clearly stating the number of technicians required, the hourly rate per technician, and the estimated amount of hours required. The Agency reserves the right to obtain competitive bids and award to other Vendors.

DEFINITION OF CHARGES
Minimum Call Charge The Minimum Call Charge shall be a comprehensive minimum charge that shall be applied to all work which includes but, is not limited to, all mileage, vehicle charges, acquisition of parts and materials, transportation of any equipment and/or vehicles to/from sites, and one hour of labour performed on site by a two-man crew, at the applicable rate.
This charge shall be applicable when the successful Vendor arrives on site to perform work requested by the Agency.
The Vendor shall only charge for the time that they are on-site performing the work.
Any time used to leave the site to purchase or pick up materials for the work required is NOT chargeable and the Agency will NOT make payment on this time.
If a Vendor needs to leave the site before completion of a job, the time on site will be recorded up to the time of departure and upon the Vendor’s return. The time will be added to the original time to completion of work.
Only one minimum charge shall apply for multiple tasks at a site and regardless of the number of times the successful Vendor must return to the site to complete the requested work.
If the requested work exceeds one hour, the successful Vendor shall bill all additional time in 30-minute increments based on the submitted Regular Labour Rate.v
If the requested work takes less than one hour to be completed, no further increment charges will apply.
Labour Charges:
If the requested work exceeds the minimum call charge time frame, the successful Vendor shall bill additional time as regular labour charges based on 30-minute increments in accordance with the vendor’s submitted pricing. Labour charges will include but, are not limited to, all mileage, vehicle charges, acquisition of parts and materials, and transportation of any equipment and/or vehicles to/from sites and are only applicable for actual work time spent on site performing the requested work.
Regular Labour Rates shall apply for service calls requested and performed between the hours of 7:00 am to 5:00 pm, Monday through Friday (excluding Saturday, Sunday and statutory holidays).
In circumstances whereby work requirements and/or completion of a job may exceed into the Overtime Service hours time zone, the successful Vendor will conduct this only when preauthorized by the Agency; and then the Overtime Labour Rate shall apply.
Overtime Labour Rates (OT1) shall apply for service calls requested between the hours of 5:01 pm and 6:59 am, Monday through Friday and anytime within the 24-hour time period on Saturdays.
Prior approval must be obtained by the Agency for work conducted during this time period.
Overtime Labour Rates (OT2) shall apply for service calls requested during the 24-hour time period on Sundays and statutory holidays. Prior approval must be obtained by the Agency for work conducted during this time period.
Emergency Service Calls The successful Vendor must be able to provide emergency service on an as required basis 24 hours per day, seven days per week, 365 days per year.
The successful Vendor shall provide high priority service to emergency service calls from the Agency’s Property Manager, or designate.
The successful Vendor must provide a contact phone number 24 hours per day, seven days per week, 365 days per year for emergency service calls.
The Agency reserves the right to request estimates, whether over the phone or while on site, for any service request at its sole and absolute discretion.
The successful Vendor shall provide the Agency with a written estimate, at no cost to the Agency, for requested work to be performed.
All work must first be ordered by the Agency and must be approved by the Agency’s Property Manager, prior to starting the work.

RESPONSE TIME
Regular Service Requests The maximum response time (to contact the Agency) is to be one hour from service call.
Maximum time for services and repairs to be completed is within 48 hours of service call by the Agency.
Failure by the successful Vendor to respond within the one-hour time frame will result in the Agency contacting an alternate Vendor to perform the work and may result in termination of the contract.
Emergency Service Requests There will be emergency circumstances whereby the successful Vendor must service the Agency immediately.
Once the emergency service request for work is identified and initiated by the Agency either by telephone, fax or in person, the successful Vendor must respond to the Property Manager or designate within 30 minutes of initial contact. Maximum time for services and repairs to be completed is within 24 hours of service call by the Agency.
Failure by the successful Vendor to respond within the 30-minute time frame will result in the Agency contacting an alternate Vendor to perform the work and may result in termination of the contract.
PARTS AND MATERIALS AVAILABILITY
All parts and materials shall be supplied by the successful Vendor and charged to the Agency accordingly.
Purchase of parts must be authorized by the Agency’s Property Manager or designate prior to replacement.
The Agency will allow the successful Vendor to mark-up all materials and parts used in connection with the execution of the requested work by a maximum of 20 per cent of the Vendor’s purchase cost.<

VENDOR IDENTIFICATION
All employees of the Vendor working under this contract are required to identify themselves as the employee of the Vendor and shall be equipped with sufficient identification for that purpose.
Such identification will indicate the name of the Vendor, the trade involved, the name and photograph of the employee and the date of issuance of the identification card.

SITE ACCESS
The Agency’s Property Manager or designate will provide the successful Vendor with access to the site. Upon starting the Work at a site, the Vendor shall complete the specified activities without interruption, adhering to the working hours outlined in this document.

PROTECTION AND SAFETY PRECAUTIONS
The Vendor must ensure that all emergency and service access routes remain clear at all times.
The Vendor shall provide protection with appropriate barriers and warning signs and make every effort to minimize inconvenience to the Agency's staff.
The Vendor must also provide protection of areas adjacent to the work site and protect surrounding private and public property from damage during performance of the Work.

SITE MAINTENANCE AND CLEAN UP
The Vendor shall maintain a clean and safe environment at all times throughout the duration of the Work as follows:
Maintain the site and adjacent premises in a clean and orderly condition, free from debris and other objectionable matter relating to the Work.
At the end of each work day, remove debris, surplus products, tools and equipment.
No hazardous or contaminated waste material shall be placed in the Agency’s waste containers.

WASTE REMOVAL
All material, debris and garbage resulting from the Vendor’s work shall be removed from the site by the Vendor and disposed of in accordance with the Ontario Environmental Protection Act, Ontario Regulation 347.
The Vendor must dispose of all materials, whether recycling or garbage in accordance with all municipal by-laws and environmental regulations.
The cost of waste removal is the responsibility of the Vendor; no additional fees will be paid by the Agency.
Each Operations Centre and Waste Management Facility has its own scrap metal bin on the property.
It is recommended that the Vendor utilize on-site Agency metal scrap bins for disposing of metal equipment waste if in accordance with all by-laws and environmental regulations.

STORAGE OF MATERIALS AND EQUIPMENT
Unless prior arrangements are made with Agency, materials and equipment shall not be stored on site upon existing roads, parking lots or other existing hard surface areas, within or adjacent to the site.
Any material not installed at the end of a working day shall be taken with the Vendor as they leave the site.
The Agency is not responsible for any damage to the Vendor equipment that is left on site.

FAULTY WORKMANSHIP/DAMAGE CAUSED BY THE VENDOR
The Vendor is responsible for all damages caused by the Vendor in relation to the execution of this contract.
Said damages will be rectified by the Vendor at no cost to and to the satisfaction of the Agency within two days of request unless additional time is granted, by the Agency.
In the event of a job having been completed and a portion or all the finished work is deemed unsatisfactory or incomplete by the Agency, the Vendor shall re-work and bear all expenses for the completion of the unsatisfactory or incomplete work, in the time frame specified by the Agency for completing the job to the Agency’s level of acceptance and satisfaction.

PROVISIONAL ITEMS
The Vendor may be required to perform works for which there is no suitable unit price item in the tender documents. These works will be done on a time and material basis.
The Vendor shall in all cases obtain written authorization from the Agency’s Property Manager or designate prior to proceeding with such works. Work involving provisional items must be approved verbally by the Property Manager, or designate, in advance with a formal quote submitted by email.
All quotes must be broken down into the following applicable categories:

and include a subtotal before taxes.
Charges for labour must include a breakdown clearly stating the number of technicians required, the hourly rate per technician, and the estimated amount of hours required. The Agency reserves the right to obtain competitive bids and award to other Vendors.
The Agency is seeking Provisional pricing from Vendor for core drilling, locates, hydro vac, power auger, dump truck skid steer, lift equipment and tractor auger services that may be required to complete the Work.
